TERMS & CONDITIONS OF SERVICE
The terms and conditions of Eat-Thrive-Flourish Ltd are set out to confirm that both parties understand the dietetics/nutritional advice services to be carried out, the costs involved, the time scale set for payments and the issues regarding data protection.
All client personal details, contact information, and sensitive data provided by or related to a client is always treated as strictly confidential. Eat-Thrive-Flourish Ltd will never intentionally divulge, disclose or communicate client information without the client’s express permission.
Description of Services:
EAT THRIVE FLOURISH is able to offer online appointments for children and their family with food allergy.
A registration form and food diary are required to be completed and return prior to your appointment.
The consultation will take 30-60 minutes, depending on the type of appointment booked.
All new assessments and consultations are conducted over one or two appointments and include a complete dietary and nutritional assessment, with dietary advice tailored to the food allergy and child.
A report, including a growth assessment is provided after the final consultation for all new assessments and consultations.
Fees as from August 2020:
Professional/Clinical Time: Please note that consultations take place on-line.
£130 for all initial consultations and/or assessments.
£70 for a review consultation of 30 minutes.
These rates will be charged for all professional time which may include:
• Dietetics visits / tele-health assessments, treatment, reviews, monitoring, meetings, training sessions.
• Communications: telephone calls, emails and text messages, tele-health.
• Record-keeping: hand-written and typed documentation, file note entries, reports (provided after the full initial consultation(s) has/have been completed), treatment programmes and letters to other healthcare professionals and to you.
• Preparations: treatment, planning, reading documentation, lengthy emails, sourcing equipment and services, arranging and coordinating appointments.
Payment of Fees:
• Payment terms are 14 days from date of invoice.
• Payment is by bank transfer.
• Invoices are issued at the beginning of each month, to be paid by bank transfer or in cash.
• Services maybe withdrawn at any time if payment remains outstanding.
• Eat-Thrive-Flourish Ltd also reserves the right to terminate this engagement and cease acting if payment of any fees billed is unduly delayed.
Private Medical Insurance:
If you hold Private Medical Insurance (PMI), please check the reimbursement level that will be available to you from your relevant provider for the dietetic advice.
Please note that two appointments may be required to complete an initial assessment.
If your PMI reimbursement does not cover the fee in full, you may be liable to pay the difference between the fee and the PMI reimbursement.
If your policy has an excess you are liable to pay the outstanding amount to the level of the excess.
You are also liable for payment of any aspects of dietetic treatment not covered by your policy.
If you have not already done so, please inform us of your PMI's pre-authorisation Code and of the limits to the funding available.
PMI invoices are raised monthly in arrears. Payment is due 14 days from the date of the invoice. Please promptly forward the invoice to your PMI provider in order for them to process payment if there is no direct payment in place.
Cancellation Policy:
• Please note that a standard charge of £130 an hour maybe charged, depending on circumstances, for missed appointments unless 1 working day (24 hours’ notice) is given.
• We will endeavour to give you as much advance notice as possible in the event of any need to cancel or rearrange a future appointment.
Data Protection:
Please see the attached Privacy Statement for full details of our Data Protection practices and your rights.
Entire agreement:
These terms constitute the entire agreement between the parties and supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.
Variation:
Eat-Thrive-Flourish Ltd may revise these terms and conditions at any time and shall notify the Client in any such event.
Waiver:
A waiver of any right or remedy is only effective if given in writing and shall not be deemed a waiver of any subsequent breach or default.
Governing law:
The Contract, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the law of England and Wales.
Insurance and ICO Registration:Eat-Thrive-Flourish Ltd is covered by Professional Indemnity Insurance (limit of £10million). We are registered with the ICO as a data controller.
